1) Agreement to Terms
These Terms of Use (“Terms”) constitute a legally binding agreement between you and LinguaProofing (“we,” “us,” or “our”) regarding your access to and use of our website and services, including academic proofreading, editing, translation, and related support (collectively, the “Services”). By using the Services, you accept these Terms and our Privacy Policy.
2) Services & Scope
We provide language-focused Services that improve clarity, grammar, style, and readability. We do not add new scientific content, change the substance of your claims, or guarantee acceptance by any journal or publisher. Our role is limited to language enhancement and presentation within the scope you select (e.g., Proofreading, Premium Editing, Scientific Editing, Translation).
3) Ordering & Files
To place an order, you may request an instant quote and then share your files through our designated channels. You represent and warrant that you have the right to provide all materials (including any personal data) to us and that doing so does not infringe any third-party rights or violate any laws or institutional policies.
4) Pricing & Payment
Pricing is typically per-word and may vary by turnaround. Final charges are confirmed at checkout or in your order confirmation. You agree to pay all fees in the currency specified. We may use third-party payment processors; you must provide accurate billing information.
5) Turnaround Times
Turnaround options (e.g., 48h, 72h, four days, or five business days) are estimates based on word count, service tier, and availability. We strive to meet your requested deadline but cannot be liable for delays caused by factors beyond our control or by late responses from you.
6) Revisions & Language-Quality Guarantee
Where offered, our language-quality guarantee applies only to rejections due to language issues alone and requires verifiable proof from the journal. At our discretion, we may provide one free re-edit within a reasonable timeframe. This guarantee does not cover content-related feedback, scope changes, or journal-specific formatting not provided to us in advance.
7) Confidentiality
We treat your files as confidential and restrict access to team members who need them to perform the Services. We may sign NDAs upon request. We will not disclose your materials to third parties except: (i) to contractors assisting with the Services under confidentiality obligations; (ii) as required by law; or (iii) with your explicit consent.
8) Data Protection
We process personal data as described in our Privacy Policy, in line with applicable data protection laws (including GDPR where relevant). You are responsible for ensuring you have a lawful basis to share any personal data with us (e.g., co-author details, patient data, or institutional information), and for minimizing sensitive data unless strictly necessary.
9) Intellectual Property
You retain all intellectual property rights in your work. We do not claim authorship or co-authorship. By providing your files, you grant us a limited, non-exclusive license to process, edit, and return them solely for delivering the Services. Any templates, tools, and processes we use remain our intellectual property.
10) Your Responsibilities
You are responsible for: (a) the accuracy and legality of your content; (b) complying with institutional, funder, and journal policies; (c) reviewing all edits and ensuring the final manuscript reflects your intended meaning; and (d) backing up your files. You must not submit unlawful, plagiarized, defamatory, or otherwise restricted material.
11) Prohibited Uses
You agree not to misuse the Services, including by attempting to: (i) obtain services for illicit or deceptive purposes; (ii) violate confidentiality obligations; (iii) upload malware or harmful code; (iv) engage in harassment or abuse of staff; or (v) infringe any intellectual property or privacy rights.
12) Disclaimers
The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that journal acceptance will be achieved, nor that the Services will be error-free or uninterrupted.
13) Limitation of Liability
To the maximum extent permitted by law, in no event will we be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities. Our aggregate liability arising from or related to the Services will not exceed the amount you paid for the specific order giving rise to the claim.
14) Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your content, or your misuse of the Services.
15) Changes to the Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the latest version. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
16) Governing Law & Jurisdiction
These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules. Courts at that location shall have exclusive jurisdiction, unless mandatory laws of your country require otherwise.
